Tampa- United States EnviroFuels LLC is set to break ground on its biofuel facility at the Port of Tampa by the end of 2008 after nearly a two-year delay.

A lawsuit filed by a nearby business at the Port Sutton site has stymied the ethanol plant's construction, but Bradley Krohn, U.S. EnviroFuel's president, said a resolution to the complaint is pending.

PEL Laboratories filed the lawsuit seeking an injunction in 2006 in Hillsborough County Circuit Court, contending EnviroFuel's corn-based facility would produce emissions that would destroy its soil and water testing business.

"We had a positive outcome of court-ordered mediation," Krohn said. "We are working on consummation of the mediation settlement."
